1.
The contract stipulated between H2O srl and the Customer must be considered concluded with the acceptance, even if only partial, of the order by H2O srl. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.

It should be noted that this right is reserved only to natural persons, that is to those consumers who act for purposes unrelated to their profession. There is no right of withdrawal for legal and natural persons acting, with reference to the purchase contract, in a professional context. Once the online purchase procedure has been completed, the Customer will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.
How to purchase

The Customer can only purchase the products present in the electronic catalog of H2O srl at the time of placing the order and viewable online at (URL) http://www.h2owaterstore.it, as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics but differ in color, size, accessory products in the figure. All purchase support information (cards, etc.) are intended as simple generic information material, not referable to the real characteristics of a single product.

Correct receipt of the order is confirmed by H2O srl by an e-mail reply, sent to the e-mail address supplied by the Customer. This confirmation message will contain the date and time of execution of the order and a 'Customer Order Number', to be used in any further communication with H2O srl. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
6.
In case of non-acceptance of the order, H2O srl guarantees timely communication to the Customer.
Terms of payment
7. Cash on delivery
In case of purchase on delivery (there is a surcharge), payment must be made exclusively with cash. "Cash on delivery is not currently available."
8. Advance Bank Transfer
In case of payment by Advance Bank Transfer, the order ordered by the Customer will be kept busy until the receipt of the proof of the transfer, to be sent to H2O srl (via fax or e-mail) no later than 3 working days from the date of acceptance of the 'order. The dispatch of the order will take place only when the amount due is actually credited to the H2O srl current account, which must take place within 7 working days from the date of acceptance of the order. Beyond these deadlines, the order will be considered automatically canceled.
The purpose of the bank transfer must include:
- the order reference number;
- the date the order was placed;
- name and surname of the order holder.
Shipping and delivery of goods
9.
H2O srl can only accept orders for delivery in Italian territory with rare exceptions in the European territory.
10.
For every order placed H2O srl issues an invoice for the material shipped, sending it by e-mail to the order holder, pursuant to Article 14 of Presidential Decree 445/2000 and Legislative Decree 52/2004 or attaching it to the shipment. For the issue of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after its issue.
11.
Delivery costs are charged to the customer. The payment of the goods by the Customer will be made using the method chosen when ordering. Nothing is more due by the Customer than the total order.
12.
No responsibility can be attributed to H2O srl in case of delay in the order or delivery of the order.
13.
Unless explicitly indicated by our Customer Service, delivery is intended at street level. Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to what is indicated in the transport document sent in advance via e-mail;
- that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps).
Any damage or the mismatch in the number of packages or indications must be immediately reported to the courier who makes the delivery. Once the courier's document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures set out in this document.
14.
In case of non-collection within 5 working days of the material in stock at the courier's warehouses due to repeated inability to deliver to the address indicated by the Customer at the time of the order, the order will be automatically canceled.
Right of withdrawal
15.
Pursuant to Legislative Decree 206/05, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in point 17 below.

To exercise this right, the customer must send to H2O srl a communication to that effect, within 14 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to:

The communication can also be sent by e-mail - info@h2o.it - telegram or fax to 06 5000386 - always sent within the aforementioned term of 14 working days and followed by a confirmation by registered letter with acknowledgment of receipt. Once we have received the aforementioned notice of withdrawal, the H2O Customer Service will quickly communicate to the Customer the instructions on how to return the goods which must be sent to H2O srl at the address indicated here, within 14 working days from the authorization.
The right of withdrawal is however subject to the following conditions:
- - The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (eg accessories, attached software, etc.);
- - If the withdrawal is partial (i.e. it concerns only a part of products delivered with a single delivery), the refund of the shipping costs incurred by the consumer for the delivery of the products at the time of purchase is excluded.
- - the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend, when possible, to put it in a second box, on which to affix the label provided H2O srl showing the RMA number (return authorization code); in all cases the affixing of labels or adhesive tapes directly on the original product packaging should be avoided;
- - according to law, the shipping costs for returning the goods are charged to the customer;
- - the shipment, until the certificate of receipt in our warehouse is under the complete responsibility of the customer;
- - in case of damage to the goods during transport, H2O srl will notify the customer of the incident (within 5 working days from receipt of the goods in their warehouses), to allow him to promptly file a complaint against the courier of his choice and obtain a refund of the value of the goods (if insured) in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
- - H2O srl is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
- - upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, H2O srl will deduct from the reimbursement due a percentage, in any case not exceeding 10% of the same, as a contribution to the restoration costs.
18.
Without prejudice to any repair costs for damage to the original packaging, H2O srl will refund the customer the full amount already paid, within 14 days from the return of the goods, by transferring the amount charged to the credit card or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the reimbursement (ABI Code - CAB - Current Account of the invoice holder).
19.
The right of withdrawal is totally lost, for lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where H2O srl make sure:
- - the lack of the external packaging and / or the original internal packaging;
- - the absence of integral elements of the product (accessories, cables, manuals, parts, etc. etc.);
- - damage to the product for reasons other than its transport.In case of forfeiture of the right of withdrawal, H2O srl will return the purchased good to the sender, charging the shipping costs to the sender.
Guarantees
20.
All products sold by H2O srl they are covered by the manufacturer's conventional warranty and by the 24-month warranty for conformity defects, pursuant to Legislative Decree 24/02. To use the warranty, the Customer must keep the invoice (or DDT) that he will receive via e-mail in PDF electronic format.
21.
The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect is not covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration requested by the Authorized Service, as well as transport costs, if supported by H2O srl
22.
The 24-month warranty pursuant to Legislative Decree 24/02 applies to products with a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form). In case of lack of conformity, H2O srl provides, at no cost to the customer, to restore the conformity of the product by repairing / replacing or reducing the price, until the contract is terminated. If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any costs of verification and restoration required by the Authorized Assistance, as well as transport costs if incurred by H2O srl
23.
The replacements in case of DOA (Dead On Arrival: product not working on delivery) take place only if expressly provided by the manufacturer. The timing of replacement or repair of the product depends exclusively on the manufacturer's policies.
24.
In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its customer, H2O srl may proceed at its discretion to return the entire amount paid or to replace it with a product of equal or superior characteristics.
25.
No damage can be claimed at H2O srl for any delays in carrying out repairs or replacements.
26.
In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original product packaging should be avoided.

Protection of personal data - Privacy
28.
Personal data will not be used for sending advertising material, promotions and the like, since this activity must require the express consent of the data owner for this purpose. This consent must be explicitly expressed by the owner and cannot be considered tacitly granted. Personal data will be used only for the purpose of processing the order and will not be given to third parties.
Applicable law
29.
The sales contract between the customer e H2O srl it is considered concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Forum of Rome.
